Congresswoman Harriet Hageman has joined Congressman Paul Gosar and 29 other Republican House members in introducing H.R.9828, known as the End the Vaccine Carveout Act. The bill aims to remove the liability shield that has protected vaccine manufacturers from lawsuits since 1986. Additionally, it seeks to redefine "countermeasures" to exclude COVID-19 vaccines, thus eliminating their current liability protection under the Public Readiness and Preparedness Act.
Representative Hageman explained, “This legislation strips away all existing provisions that shield vaccine manufacturers from liability and redefines COVID-19 vaccines to remove public health emergency protections. We will finally give victims and families the ability to pursue legal action for damages caused by vaccines. Protecting companies from consequences of poorly developed and rushed vaccines has led to immense health concerns and, in some cases, death. It is my hope that the Committee on Energy and Commerce quickly considers this bill and recommends it advance to the House floor for a vote.”
The introduction of this bill follows a recent hearing by the House Judiciary Subcommittee on the Administrative State, Regulatory Reform, and Antitrust. During this hearing, there were discussions on how the Biden-Harris administration allegedly pressured the Food and Drug Administration (FDA) to lower its standards for approving the Pfizer COVID-19 vaccine and boosters. Congresswoman Hageman specifically questioned witnesses about what she described as "anemic" trials for these vaccines.
